Terms and Conditions

 Swat Sasta Bazar accepts all Advertisements from any person/customer for publication in websites under its control or represented by Swat Sasta Bazar under a contract, agency, reseller or similar representative arrangement on the following terms and conditions. These Terms and Conditions will apply to: 
(a)     Classified advertising in swatsastabazar.com.
(b)     Online banner advertising on swatsastabazar.com.
(c)     Online advertising on swatsastabazar.com other than Banner Advertising.
(d)     all other advertising services provided to the Customer by swatsastabazar.com. in relation to Advertisements.
CUSTOMER:The expression Customer means the advertiser and, where any Advertising has been placed with swatsastabazar.com by an advertising agency , includes that agency,and all obligations (including payment obligations), warranties, indemnities, releases and discharges expressed to be given under these Terms and Conditions by the Customer are expressed to be given by the advertiser and the advertising agency on a joint and several basis.
ENTIRE AGREEMENT:The Terms and Conditions set out the entire agreement between the parties in relation to any Advertising and supersedes all prior arrangements, undertakings, representations and warranties by or between the parties in relation to such Advertising.SUBMISSION OF ADVERTISING: If submitting any Advertisements, the Customer must comply with the submission requirements.PUBLICATION:(a)    Swatsastabazar.com will publish classified Advertisements under the classification heading that it reasonably believes is most appropriate.(b)     Without limiting the above, if Swatsastabazar.com, reasonably believes that the placement instructions of the Customer for an Advertisement are inappropriate for any reason, Swatsastabazar.com may offer the Customer alternate placements. If the Customer does not accept the alternate placements, the existing ad will be removed.

CUSTOMER UNDERTAKINGS:

The Customer undertakes and warrants to Swatsastabazar.com that no Advertisement will:

(a)     breach or infringe the Competition and Consumer Act.

(b)     infringe copyright, trade mark or moral property rights of any person.

(c)     contain material that is obscene, offensive, or unsuitable for publication.

(d)     breach or infringe any laws relating to therapeutic goods, financial services, anti-discrimination, political publication, publication of court or tribunal materials, or any other State or Commonwealth legislation, rule or ordinance.

 

SWAT SASTA BAZAR RIGHTS:

If in Swatsastabazar.com reasonable opinion, the Advertisement breaches any term of these Terms and Conditions or the publication of the Advertisement may damage Swatsastabazar.com reputation or would otherwise be contrary to Swatsastabazar.com legitimate business interests, Swatsastabazar.com may:

(i)   at any time and without notice to the Customer cancel, reject or refuse to publish or continue publishing any Advertisement at any time prior to, or after, publication of the Advertisement, provided this right will not be unreasonably exercised.

The Customer acknowledges that it remains responsible for all Advertisements submitted by it and swatsastabazar.com has no obligation to review any Advertisement nor to alter, amend, cancel, reject or refuse to publish or continue publishing any Advertisement.

The Customer agrees that Swatsastabazar.com may publish or re-publish an Advertisement in other Swatsastabazar.com Categories.

NO GUARANTEE OR WARRANTIES: 

Swatsastabazar.com does not guarantee that the Customer’s product featured in an Advertisement will be the only product of that type featured in Advertisements on any one page. Swatsastabazar.com will not be responsible or liable to the Customer in any way if the product featured in the Customer’s Advertisement is not the only product of that type featured in Advertisements on any one page.

Online Advertising will be published via internet accessible Swatsastabazar.com website. Swatsastabazar.com makes no warranties of any kind, whether express or implied of the fitness of Swatsastabazar.com for a particular purpose. Swatsastabazar.com shall not be liable for any loss, damage, or expense incurred in connection with Swatsastabazar.com use of the Software, including without limitation, for any technical malfunction, computer error or loss of data or other injury, damage or disruption of any kind other than as a result of Swatsastabazar.com gross negligence or fraud.

PAYMENT:

The Advertiser can purchase a package for Advertisements:

if payment is agreed by Swatsastabazar.com to be on account, the full amount should be paid in order to activate the package and get benefits.

PRODUCTION SERVICES:

If the Customer requires any creative, production, programming, or other services from Swatsastabazar.com, the Customer must pay Swatsastabazar.com additional charges for such services, as notified in writing to the Customer by Swatsastabazar.com at the time the Customer requests the Production Services or shortly after that time (but before the Production Services are provided).

FAILURE TO PAY:

If any payment is not received by swatsastabazar.com on or before the date that such payment is due, Swatsastabazar.com may:

(a)     immediately and without notice, suspend or cancel all Advertisings and packages of the Customer and terminate any agreement in relation to Advertising not yet published, and in relation to which payment has not yet been received.

(b)     take proceedings against the Customer for any outstanding amounts.

(c)     exercise any other rights at law.

LICENSING AND SYNDICATION:The Customer grants to Swatsastabazar.com a worldwide, non-exclusive, sub-licensee, royalty free license to use, distribute, reproduce, modify, adapt, publish, translate and publicly display the Advertisements in any print or online publication.CONFIDENTIALITY:All information supplied by Swatsastabazar.com to the Customer in relation to Swatsastabazar.com finances and affairs, contracts, pricing, methods of business and any other information which is designated confidential by Swatsastabazar.com or ought reasonably be regarded as confidential is confidential to Swatsastabazar.com and the Customer must maintain strict confidentiality in respect of such confidential information.SEVERABILITY: 

If any provision of these Terms and Conditions is held illegal or unenforceable, then such illegality or unenforceability shall not affect the remaining provisions of these Terms and Conditions which shall remain in full force and effect.

PRIVACY:

Swatsastabazar.com also collects some customer information to assist in providing services to the Customer and to improve Swatsastabazar.com products and services. Swatsastabazar.com may contact the Customer about ads, services or promotions which may be of interest to the Customer. Personal information will be dealt with in accordance with our Privacy Policy. Swatsastabazar.com will never share the customer personal information to anyone or any third party organization until there is some fraud or govt. needs.
